Citizen ship to the kids under age 18 with green cards.?

Hi,

Will my kids get the citizen ship automatically if one of the parents became a naturalization citizen?. Both of my kids got the green cards and under 18 years age. They are living with both the parents. My spouse's citizen ship may get delayed by few months as she has an issue with her finger prints.
I appreciate your help.

Wow. The answers here are all over the place.

It is the GREEN CARD that is "automatic" for dependent minors who accompany a parent into the US. But citizenship must be applied for by each individual. The parent's having achieved citizenship after first holding a Green Card does not, then, automatically convey citizenship to the minor dependent children who accompanied said parent into the US.

The children eventually getting their citizenship, though, when the time is right, should be no problem. It should also be no problem for them to get their Green Cards renewed when they are about to expire. If you're worried that they'll be thrown out of the US or something like that, I'd say fear not... that is, as long as they don't commit felonies. People live in the US for their entire lives with just a Green Card. They just renew the card every 10 years, and stay out of trouble with the law, and they have no problems. Of course, they can't vote, or serve on a jury, or be an owner in a Limited Liability Company and a whole long list of other things which only US citizens can do. But that doesn't seem to bother many people, and so they just live here with a Green Card pretty much forever.

I don't recomment that, of course. The benefits of citizenship are many, varied, and sometime intangible. It's difficult to describe in words, but there's something about getting one's citizenship that just makes many immigrants feel better about things in life... in ways even they sometimes find difficult to articulate. So, whenever a person has been in the US long enough on a Green Card to finally apply for citizenship, I always recommend that they do. It has become quite a bit more expensive lately than it used to be, but it's still affordable and worth it.

As for your wife's fingerprint problem, please listen to me on this: Applying for citizenship (or even just a Green Card) should go very smoothly. If there's a problem, even a seemingly small one, all kinds of red flags should go up, and alarm bells should go off, for the applicant; and the applicant should, right then and there, without delay, GET AN ATTORNEY with immigration expertise. I cannot even BEGIN to emphasize this strongly enough. I have seen minor and seemingly explainable immigration issues turn in to someout unbelievably weird and complex; and ultimately result in the applicant being rejected... sometimes, on rare occasion, even unable to resume Green Card status. In the rarest circumstances, they end-up being deported. You would not belive how easily (and weirdly) it can happen. And the folks at ICE have a nasty habit of doing things will little notice, and with little recourse for the immigrant.

Your spouse needs to hire an immigration lawyer right now. And I mean RIGHT NOW. The lawyer will get to the bottom of whatever is the figerprint problem, and s/he can then get ICE to get it resolved... including dragging ICE into court and having it explain to a judge what is causing the delay. I say all this because fingerprint problems can often turn into allegations by ICE that the applicant once applied under a different name (even if s/he never did). Of course applying multiple times under different names is cause for automatic denial of citizenship, revocation of Green Card, and deportation. The applicant would not be able to re-apply after that for many years... ten years, at the very least, if ever. If ICE decides that that's what's going on, its actions will be both swift and severe. If your spouse doesn't already have an attorney in place, it will all happen too fast for her to then get an attorney unless maybe she has help from someone on the outside (because, by then, she'd be in custody).

Do not mess with this fingerprint thing. It may SEEM innocent, minor, inconsequential. And it probably is. But it's worth it to have an attorney on the team BEFORE it starts getting weird... and it can get weird REALLY fast... without warning.

Stop worrying about the kids' citizenship for now. That will take care of itself in time. For now, turn your attention toward that seemingly innocuous fingerprint problem by GETTING HER AN IMMIGRATION ATTORNEY. Right now.
